GENERAL TERMS & CONDITIONS (T&C)

1. Scope of Application

These General Terms & Conditions (T&C) apply to all business relationships between Madhukar - Enlighten Life, Madhukar Merkle B.J., Marktplatz 7, CH-5080 Laufenburg/AG, www.madhukar.org (hereinafter "Provider"), and its customers (hereinafter "Participants"), in particular for the booking and participation in events and retreats, which are conducted online or on-site.

Deviating or supplementary conditions of the Participants shall not apply unless expressly accepted in writing by the Provider.


2. Offer and Contract Formation

The offers presented on the Provider's website do not constitute a legally binding offer, but rather a non-binding invitation to book.

A contract is concluded as soon as the Participants complete a booking via the web shop and this is confirmed by the Provider via email or the payment is successfully completed.


3. Bookings via Web Shop

Booking of events and retreats (online and on-site) is exclusively via the Provider's web shop.

By completing the booking, Participants agree to these T&C. Participants are obliged to provide truthful and complete information when booking.

The Provider reserves the right to refuse bookings without giving reasons.


4. Prices and Payment Terms

All prices are stated in Euro. Payment is generally due immediately upon booking.

Only after full payment has been received is there an entitlement to participate in the booked event or retreat (online and on-site).


5. Cancellation and Refund

Strongly Recommended: Travel Cancellation Insurance

Participants are expressly and strongly advised to take out travel cancellation insurance and travel health insurance for their own protection, in order to avoid any financial disadvantages in the event of cancellation, illness, or accident.


Cancellation by Participants

In the event of cancellation by the participant, the following conditions apply:

  • Reservation, booking, registration, and processing fees are non-refundable and non-transferable under any circumstances.

  • Cancellation must be made in writing (e.g., via email to info@madhukar.org). The time of receipt of the cancellation by the Provider is decisive for compliance with the deadline.


Refund Policy

Cancellation more than 30 calendar days before start:
If cancellation occurs more than 30 calendar days before the start of the respective event or retreat (online or on-site), the participant is entitled to a refund of the participation fee already paid minus the non-refundable processing fees, as listed in the fee schedule below.


Cancellation 30 calendar days or less before start:
If cancellation occurs 30 calendar days or less before the start of the event or retreat (online or on-site), there is no entitlement to a cash refund.

Instead, the Provider will issue a voucher worth 100% of the participation fee paid (minus non-refundable processing fees). The voucher is valid for two (2) years from the date of issue, is non-transferable, and can only be redeemed for an event or retreat (online or on-site) of the Provider.

The voucher must be kept by the participant and presented upon redemption; in case of loss, there is no entitlement to replacement.

It is the sole responsibility of the participant to know and comply with the relevant deadline (30 days before the event start).


Processing Fees Overview

In case of cancellation, the following processing fees apply:

  • Tiruvannamalai: €200

  • Summer Retreat: €200

  • Kitzbühel: €100

  • Laufenburg: €100

  • Online Retreats: €50

Why are processing fees non-refundable?
Processing fees cover administrative costs (e.g., booking system, payment processing, communication) as well as advance payments already made to venues and partners.


Processing Time for Refunds

If a cancellation is requested more than 30 days before the event start, the Provider reserves the right to take up to 20 business days to review the refund request and, if approved, to initiate the refund.


Exceptions in Cases of Hardship

In exceptional cases (e.g., serious illness, death in the family, verifiable emergencies), the Provider may, at its sole discretion, offer an individual solution. There is no legal entitlement.


Binding Nature of Booking

By submitting the booking and payment, a binding contract is concluded. The participant is personally responsible for the complete and timely payment of all mandatory fees, regardless of whether participation is actually taken.


Waiver of Right of Withdrawal (for EU Customers)

Participants residing in the European Economic Area (EEA) expressly agree that the Provider will begin providing the service (provision of retreat places, online access, etc.) immediately after conclusion of the contract, and hereby expressly waive their right of withdrawal under the EU Consumer Rights Directive.


5a. Cancellation by the Provider

Cancellation for Organizational Reasons

The Provider reserves the right to cancel an event or retreat if the minimum number of participants is not reached or for other organizational reasons. In this case, participants will be informed immediately and will receive a full refund of the participation fee paid.


Cancellation Due to Force Majeure

In case of cancellation due to force majeure (e.g., natural disasters, pandemics, war, government orders, venue unavailability), there is no entitlement to a refund. Instead, a voucher in the amount of the participation fee paid will be issued, which can be redeemed for a future event or retreat of the Provider. The voucher is valid for two (2) years from the date of issue.


6. No Right of Return

Since the events and retreats offered are services, there is no right of return or withdrawal.


7. Participation Conditions for Events and Retreats (online and/or on-site)

By registering and participating in an event or retreat (online and on-site) of the Provider, Participants agree to:

  • assume full responsibility for their physical and mental health during the entire event or retreat as well as during travel to and from the event,

  • decide independently whether the content, activities, or exercises offered are suitable for them,

  • assume full responsibility and liability for self-inflicted damage to accommodations, venues, seminar rooms, or other facilities.

By registering and participating, Participants expressly acknowledge these participation conditions.


Medical Fitness

Participants confirm that they are in a state of health that allows them to participate in the activities offered. In case of pre-existing conditions, pregnancy, or other health limitations, it is strongly recommended to seek medical advice before participation.

Participants acknowledge that the activities offered (e.g., meditation, yoga, breathing exercises) may involve physical and mental exertion. Participants are responsible for having their health status medically assessed before participation and for respecting their physical and mental limits during the event or retreat.

The Provider assumes no liability for health, physical, or psychological impairments arising from voluntary participation in the activities offered, unless such impairments are caused by the Provider's intent or gross negligence.


8. Liability

The Provider's liability is – to the extent legally permissible – limited to intent and gross negligence.

No liability is assumed for indirect damages, consequential damages, or lost profits.

No liability is assumed for personal belongings of Participants.


9. Photo and Video Recordings During Events and Retreats

During events and retreats, photos and videos are regularly taken, which may include participants.


Consent to Publication

During booking, participants will be asked whether they consent to the publication of photos and videos in which they appear on the Provider's website (www.madhukar.org), social media channels (e.g., Facebook, Instagram, Pinterest, YouTube), and newsletters.

This consent is voluntary and can be revoked at any time. Revocation does not affect participation rights.


Objection On-Site

Participants who do not wish to be photographed or filmed may inform the organization in writing at least 1 day before the event or contact the organization team on-site.


10. Recording Ban and Copyrights at Events and Retreats (online and on-site)

For copyright and personal rights reasons, recordings of any kind during events and retreats (online and on-site) conducted by the Provider are expressly prohibited.

This includes, but is not limited to:

  • Audio and video recordings

  • Photos

  • Video recordings

  • Screenshots

  • Screen videos

  • Other digital or analog reproductions

All copyrights and usage rights to image, audio, and video material from events and retreats (online and on-site) belong exclusively to the Provider.

Unauthorized recording, reproduction, distribution, publication, or other use – in whole or in part – is prohibited without prior express written consent of the rights holder and may result in legal action.


Consequences of Violations

In case of violations of the recording ban, the Provider reserves the right to exclude the person concerned from further participation in the event or retreat, without any entitlement to a refund. Legal action may also be taken.


11. Data Protection

The processing of personal data is carried out in accordance with the applicable data protection regulations of Switzerland (revDSG) and, where applicable, the General Data Protection Regulation (GDPR). Further information can be found in the separate privacy policy on the website.


12. Changes to the T&C

The Provider reserves the right to change these T&C at any time. The version valid at the time of booking is decisive.


13. Applicable Law and Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Place of jurisdiction is – to the extent legally permissible – the Provider's registered office in Switzerland.


For Consumers Residing in the European Economic Area (EEA)

Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected. Consumers may also bring actions before the courts of their country of residence.
